so for those of you who know me, have probably heard I was involved in an assault and attempted sexual assault last year. I had walked in on a robbery in progress and was blind sided by the guy coming through the kitchen and beating me upside the head. We they actually caught the guy... We have been through all kinds of stuff with court. And sometimes it seems like the court is just catering to this ***hole who beat me up, tried to rape me, and then left me for dead. We haven't had a SINGLE court event that wasn't postponed at least once. But finally the guy plead guilty and all we are waiting on now is the sentencing hearing, so we can find out how many of the 55-65 years, that were recommended by the states attorney, this guy is going to actually get. To get him to agree to that plea they had to take the sexual assault charge off the table and instead charge him with a 1st degree assault. I wasn't to happy about this seeing as how he then doesn't get labeled as a sexual offender, but at least he would get the same amount of time and I wouldn't have to go through the whole trial process. The original hearing was supposed to be back in early Dec. Then the *** had to go pick a fight with his lawyer and now they are calling it a conflict of interest and he gets a new one. So they rescheduled. for tomorrow... Jan, 17th. I fully expected it to be postponed again, but after calling the states attorney's office about every other day for the past week and being told that we are still on I finally started believing that this could be over with tomorrow. my family and Brett's all took off work to be able to be there and support us, I have my impact statement all ready and I was finally mentally prepared to go up and face him again. Then I got that phone call today. His new attorney needs more time to prepare so they are asking for a postponement. And I was also informed that he might also be appealing the guilty plea. So... It continues. I still can't put it behind me and don't see this changing any time in the near future.

The worst part is that they keep allowing him to get away with this stuff because if they don't then they are afraid that telling him no would be grounds for an appeal. So when does it end????? When will they say enough is enough. When with the so called JUSTICE system stop making me feel like more of a victim than I already am?

You have every right to feel that way!!! In this country criminals have more rights than the victim. WE have to make sure we are not violating his civil rights,,, not that he gave a crap or gave the slightest thought to yours. Hold your chin up high, and I hope things go well for you and he gets his in the end!

It is rough being on a emotional roller coaster, never wanting to get you hopes up as the carpet might be pulled out from under you again and again. Try talking with a support group in your area, maybe they can share their experiences with you and maybe shed some light at the end of the tunnel (I'm sure others have thought the same thing also). Keep on keeping on and you know we are all hear to lend and ear or a herps shoulder to cry on.

That really, really sucks. I'm sorry, Shell. It seems like "justice" is only for the people who don't deserve it. We treat our criminals so well. Who cares about their rights? That guy didn't have a problem encroaching on yours!

I hope he gets what's coming to him, I really do.
