HC Advertising Terms of Service
This agreement is between the advertiser, the person, agency, or representative that is contracting/paying for the advertising, and "HC Advertising" referred to as "the site - webmaster" for the purposes of this agreement. Advertisements may only be contracted by individuals actually in control or authorized by the subject business of the advertisement to enter into this agreement. If there is any doubt or dispute, relating to any aspect of this agreement, the webmaster's determination is final. Any advertisement contracted fraudulently is not subject to credit or refund, and as with any advertisement, it may be removed by the site at anytime.
HC Advertising reserves the right, in its sole discretion, to reject, refuse, restrict, suspend, or terminate your account to all or any part of the site services at any time, for any reason, with or without prior notice, and without liability.
Funds uploaded to your account are non-refundable.
The information on this website, relating to advertising, is in addition to the website Privacy Policy, including but not limited to those existing as well as future disclaimers and policy information. Your viewing, use, payment, e-mail exchange, the act of reading this, purchase of advertising, are each a confirmation of your acceptance of any and all present and future website terms of service, legal notices, as well as all updated disclaimers.
Advertising is generally pre-paid in advance. Your account balance reflects the amount of funding you have dedicated to your ad campaign.
The pricing schedule for HC Advertising has been carefully researched. The idea is to have as many advertisers as possible, and not just a few big ones. We make our packages available to every price range out there. If the price seems too high to you, or the value low, please do not spend your hard earned money on advertising with us. There are lots of ways to advertise your business or activity. You don't need to be excessively worried about the cost and effectiveness of any one part of your advertising program.
The fact that this is an internet website has been taken into account when this Terms of Service was drafted. The pricing is computed with the consideration that servers crash, ISPs are not perfect, back-ups can and will fail, your advertisement may not be available for viewing all of everyday of the year at every minute of the day. If the website is having technical problems, be assured that everything is already being done that can be. Our service provider has maintained our network with over 99.9% uptime! We charge by impression so that our advertisers get every pennies worth of their advertising funds. If the server goes offline for general maintenance or for repairs, your account will not be billed for those sites serving the ads directly on our server.
The form and content of the HC Network will change through time. Significant changes in the website do not invalidate any part of this agreement. The webmaster will learn more about how websites and technology work, and it can only result in a better websites and advertising resources. You can expect to see a great expansion of content within the HC Network. The webmaster reserves the right to move an advertisement from one section to another (pending a change of layout) in the interest of our advertisers and the new layouts.
If an advertiser wishes to have an advertisement removed from the Website prior to the expiration of the funds balance remaining, there will be NO refund. If there is a change in business requiring a different banner, of same or smaller size, you can freely alter your banner by replacing it using your account screen.
Failure to respond to e-mails, or depletion of account funds will result in advertising termination. You can always log into your control area, at any time, and upload additional funds or add/change plans.
Cancellation of an advertisement, listing, or banner prior to actual upload to the website is possible. You MUST contact us via email, using our "Contact Form" notifying us of your wish to terminate the campaign. This does not apply if your campaign has begun displaying ads.
Cancellation of an advertisement, listing, or banner can also occur if your advertisement is found to mislead, divert, forward, or otherwise manipulate the system into advertising for 3rd party sites that have been denied, or would have been denied, access to our advertising programs. This is a private advertising service and we choose whom shall and shall not receive advertising through our services. Upon notification of said manipulation, we will terminate the account and you will NOT receive a refund. Manipulations of our services are frowned upon and you will lose any ability to future advertising campaigns.
HC Advertising shall not be liable for errors of any type. This includes actual or consequential damages of any kind. It is the responsibility of the Advertiser to detect and report errors immediately. The website will always provide a method of approval. The Website will not be liable for slight changes or typographical errors that do not lessen the value of an advertisement.
The advertiser and/or representative agrees to defend, indemnify, and hold harmless HC Advertising against any and all liability, loss or expenses arising from all claims including but not limited to claims of libel, unfair competition, unfair trade practices, infringement of trademarks, copy-rights, trade names, patents or proprietary rights or violation of rights of privacy resulting from the publication of the advertiser's advertisement arising out of that contract including claims arising from the sole negligence of the publisher.
This is the only agreement you have with HC Advertising . The Webmaster is not bound by any verbal agreements, waivers, promises, representations, conditions, other than those found on the advertising information page, this TOS, Legal Information and Disclaimers. The Webmaster reserves the right to accept or reject any advertisement at any time. The Webmaster or his appointed representative is the sole arbitrator of all disputes relating to any aspect of advertising on the Website.
HC Advertising reserves the right to change the rates, at anytime.
HC Advertising is much more reasonable than these legalistic statements would likely indicate, but when in doubt, please do not spend your advertising money with this Website. It isn't worth becoming embroiled in disagreements related to something as straight-forward and simple as taking out an advertisement on a website. This is simply to protect the website from any fraudulent legal cases.
Your inquiry, payment, conversation with advertising staff, and review of these rules, constitute acceptance to all of the rules presently displayed, and to any changes, contained in the future agreement. If any of these rules is deemed illegal, it does not invalidate this agreement in it's entirety.
